Terms of Service

1. Agreeing to these terms

By using nabatech.info, the Gardening Expert chat, or the NabaTech App, you agree to these terms. If you do not agree with them, please do not use the service.

You must be at least 18 years old to use NabaTech, or to use it under the supervision of a parent or guardian who accepts these terms on your behalf.

These terms should be read together with our Privacy Policy, which explains how we handle your data.

2. What NabaTech provides

NabaTech is an AI agronomy platform built for the UAE climate. Depending on how you use it, we may provide:

• Garden Designer — AI-generated garden plans, including layouts, plant lists, indicative cost breakdowns and harvest projections
• “My Garden” dashboard — task scheduling, reminders and progress tracking
• Gardening Expert — an AI chat assistant that answers gardening questions in English and Arabic
• Consultations — scheduled sessions with a member of the NabaTech team
• NabaTech Community — a space to share experience with other growers

We may add, change or withdraw features as the platform develops.

3. Important: how to treat AI guidance

• It can be wrong. AI systems can produce answers that are inaccurate, incomplete or out of date. Check anything important before you act on it.
• Costs are estimates. Figures such as “estimated cost from AED 3,700” are indicative planning numbers based on typical conditions. They are not quotations, and actual prices will vary with your site, materials, suppliers and timing.
• Yields are projections. Harvest projections depend on weather, soil, water quality, pests and how the garden is maintained. We do not guarantee any yield.
• ESG figures are indicative. CO₂ sequestration and other sustainability metrics are modelled estimates for your own awareness. They are not audited, certified, or suitable for regulatory or corporate ESG reporting without independent verification.
• It is not specialist advice. NabaTech does not provide agricultural engineering, structural, legal, financial, veterinary or medical advice. For plant health emergencies, pesticide handling, structural work, or anything affecting food safety, consult a qualified professional.
• Check before you eat. Never eat a plant, fruit or seed on the strength of an AI identification alone. Confirm with a reliable source first.
• Follow the law. You are responsible for complying with UAE regulations and any community, landlord or municipality rules covering planting, water use and chemicals at your location.

You use AI-generated guidance at your own discretion and risk.

4. Consultations and bookings

• When you book through the chat, we create an appointment and send a calendar invitation to the email address you provided. Please check that the details are right.
• A booking is confirmed only once you receive that invitation. If it has not arrived within a few minutes, check your spam folder, then contact us at heba@nabatech.ai.
• To cancel or reschedule, please give us at least 24 hours' notice where you can, so we can offer the slot to somebody else.
• We may need to reschedule a consultation. If we do, we will offer you an alternative time.
• Where a consultation is paid for, the price, payment method and any refund terms will be agreed with you in writing before the session.

5. Your account and the App

• You are responsible for keeping your account credentials confidential and for activity that happens under your account.
• Please give us accurate information and keep it up to date.
• Tell us promptly if you believe someone else has accessed your account.
• We may suspend or close an account that breaches these terms.
• Downloading and using the NabaTech App is also subject to the terms of the app store you download it from.

6. Acceptable use

When using NabaTech, please do not:

• Use the service for anything unlawful, or to harm, harass or impersonate anyone
• Send content that is abusive, misleading, or infringes someone else's rights
• Attempt to gain unauthorised access to our systems, or disrupt or overload the service
• Scrape, copy or resell our content or AI outputs as a competing service
• Try to extract our underlying prompts, models or system instructions
• Submit other people's personal data without their permission

7. Your content and ours

What you upload

You keep ownership of the photographs, measurements, descriptions and other content you provide. By submitting it, you give us permission to use it for the purpose of delivering the service to you — for example, generating your garden plan and answering your questions.

What we generate for you

The garden plans, plant lists and recommendations we generate for you are yours to use for your own gardening projects, personal or commercial. You may not resell them as a standalone product or present them as the output of a competing platform.

What belongs to us

The NabaTech name, logo, website, App, design and underlying software remain our property and are protected by intellectual property law. These terms do not transfer any of it to you.

8. Third-party services

NabaTech relies on third-party providers — including n8n, OpenAI and Google — to operate the chat, bookings and calendar invitations. Our Privacy Policy lists them. We are not responsible for those providers' own services, and an interruption at one of them may interrupt NabaTech.

9. Availability

We work to keep NabaTech available, but we provide it “as is” and cannot promise uninterrupted or error-free service. We may suspend the service for maintenance, updates or reasons beyond our control, and we may change or discontinue features.

To the extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Liability

To the fullest extent permitted by UAE law:

• We are not liable for indirect or consequential loss, including lost profits, lost crops, lost data, or wasted expenditure on plants, materials or labour.
• We are not liable for loss arising from your reliance on AI-generated guidance, as described in section 3.
• Where we are found liable, our total liability is limited to the amount you paid NabaTech in the 12 months before the claim arose, or AED 1,000, whichever is greater.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud.

11. Governing law

These terms are governed by the laws of the United Arab Emirates. Any dispute will be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

If any part of these terms is found unenforceable, the rest remains in force.

12. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they last changed. If a change is significant, we will say so clearly on the website. Continuing to use NabaTech after a change means you accept the updated terms.
